Data privacy statement
§ 1 What is personal data (personal details)?
Personal data is all details and information relating to a particular or determinable person. In connection with internet presence, this includes, without being limited to, e-mail addresses, but also the IP address.
§ 2 Owner of the data collection
In connection with the services offered on the websites of Reachbird AG, the Reachbird AG collects data from the user/customer. Reachbird AG is the owner of this data collection. The contact details of Reachbird AG can be found in § 9 of this data privacy statement.
§ 3 What personal details are gathered by Reachbird AG?
In order to make use of services of Reachbird AG, the user/customer must carry out a one-off registration. For the registration, a connection is created with Facebook, Twitter or Instagram, by means of OAuth. After successful identification and authorisation of the access to the account, the following personal data of the user/customer is gathered: name, e-mail address and the associated social media profile. If the website is used as an influencer, other personal data is gathered: address, billing address, telephone number and the data of the desired method of payment and the data related to this (esp. Paypal or WireTransfer contact data). Security Advice: Reachbird AG will never ask the user/customer via e-mail or in any other way for his/her login data (especially for his/her password). Furthermore, Reachbird AG saves and/or processes those personal details that the user/customer enters directly into the appropriate text or search fields on the websites of Reachbird AG, as well as the correspondence that the user/customer sends to Reachbird AG.
As soon as the user/customer calls a page of the internet presence of Reachbird AG and uses the services of Reachbird AG, Reachbird AG also automatically saves the following data: IP address (internet protocol), browser used, internet service provider, historical and current times at which the website was called, data about the surfing and purchasing behaviour of the customer/user, and the data generated in the framework of the technical aids used (see § 4 below) is processed. Moreover, all (where applicable) declarations of consent of the user/customer regarding this data privacy statement are logged by Reachbird AG.
In future visits of the internet site of Reachbird AG, the user/customer can log in by means of OAuth authentication (Facebook, Instagram or Twitter). If the user/customer is logged in with his user account, Reachbird AG can assign this information directly to the user account of the user/customer.
§ 4 What technical aids does Reachbird AG use?
Reachbird AG analyses the use of its internet presence by means of the web analysis tools below. These tools are installed on the respective web servers of the provider. An exception to this is a cookie that is used by Reachbird AG for the authentication of the user.
Facebook remarketing / retargeting: Remarketing tags of the social network Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA are integrated on our website. When you visit our website, remarketing tags establish a direct link between your browser and the Facebook server. This informs Facebook that you have visited our website with your IP address. Facebook is therefore able to assign our website to your user account.
We use the information thereby gathered to display Facebook ads. Please note that as the website provider we do not receive any information about the content of the transmitted data or utilisation thereof by Facebook. Further relevant information is set out in Facebookâ€™s data protection declaration under https://www.facebook.com/about/privacy. If you do not want data to be recorded via Custom Audience, you can deactivate Custom Audience here.
Cookies: Cookies are files which are sent to the user's server when a particular website is called and which is sent back again when the site is accessed again. They typically contain data about visited websites, which the web browser saves during surfing on the internet. They can mean, for example, that the user/customer does not have to log in again when repeatedly visiting an encrypted page and can save information about complex internet behaviour of the user and convey this to the server. You can prevent the saving of cookies by making the appropriate adjustment to your browser software; we point out, however, that in this case you may possibly not be able to use all functions of this website in their full extent.
Facebook, Instagram and Twitter OAuth Application: For registration, Reachbird AG uses OAuth technology and apps of Facebook, Instagram and Twitter. By registering and authorising the respective application, the user/customer grants Reachbird AG access rights to the data of the selected social media accounts. In the case of Facebook this concerns: e-mail, public profiles (publicly accessible information such as: ID, name, sex, language) and lists of the user's friends. The Twitter application requests the following rights: reading tweets from the timeline and displaying who the user/customer follows. The Reachbird AG Instagram application retrieves the user name of the Instagram account. This information is processed and saved for the purpose of registration.
Mixpanel: This website uses Mixpanel, a piece of software for the analysis of user accessing. Mixpanel uses so-called "cookies", text files that are saved on your computer and which allow analysis of the user's/customer's use of the website. The information generated by the cookie about the use of this internet presence by the user/customer is saved on the server of the provider. The user/customer can prevent the installation of the cookies by making an appropriate adjustment to their browser software; Reachbird AG points out to the user/customer, however, that in this case the user/customer may not be able to use all functions of this website in their full extent.
New Relic: Reachbird AG uses a plugin of the web analysis service of New Relic. It enables Reachbird AG to gather statistical analyses of the speed of the website. This service is operated by New Relic Inc., 188 Spear Street, Suite 1200 San Francisco, CA 94105, USA ("New Relic").
Hotjar: Hotjar records the interactions of randomly selected, individual visitors with the internet site. This creates a log of e.g. mouse movements and clicks with the aim of showing up possibilities for improvements to the respective internet site. In addition to this, information on the operating system, browser, incoming and outgoing referrals (links), geographical origin and resolution and type of terminal is analysed for statistical purposes. This information is not personal and is not passed on to third parties by Hotjar. If the user/customer does not want recording, they can deactivate this on all websites that use Hotjar by setting the DoNotTrack header in their browser. Mandrill and MailChimp: For the administration of the mailing list and the sending of the newsletter of Reachbird AG, Reachbird AG uses the mailing service "MailChimp". For the sending of transactional e-mails, Reachbird AG uses the mailing service "Mandrill". MailChimp and Mandrill are provided by The Rocket Science Group, LLC, 512 Means Street, Ste 404 Atlanta, GA 30318. This company is a member of the so-called Safe Harbour agreement, a special data privacy agreement between the European Union and the United States. The user/customer can find other information on data privacy conditions of MailChimp and Mandrill at https://mailchimp.com/legal/privacy/ and http://mandrill.com/privacy/. These services enable Reachbird AG to administer a databank with e-mail contacts, in order to communicate with the user/customer by e-mail. The services administer data about the date and time at which an e-mail has been read by the user/customer, and about when the user/customer has interacted with incoming e-mail messages, e.g. by clicking on links contained in the e-mail.
Social Media Plugins: Facebook plugins (like button): plugins of the social network Facebook (1601 South California Avenue, Palo Alto, CA 94304, USA) are incorporated into this website. The Facebook plugins can be recognised by the user/customer by the Facebook logo, the "like button" on this website. The user/customer can find an overview of the Facebook plugins here: http://developers.Facebook.com/docs/plugins/. If the user/customer visits this website, a direct connection is established between their browser and the Facebook server via the plugin. Facebook thereby receives the information that the user/customer with their IP address has visited this website. If the user/customer clicks on the Facebook "like button" while being logged on in their Facebook account, they can link the contents of this website on their Facebook profile. Due to this, Facebook can assign the visit of the pages of Reachbird AG to the user account of the user/customer. Reachbird AG points out that it, as the provider of the pages, receives no knowledge of the transferred data or its use by Facebook. § 5 For what purpose are the personal details gathered?
Reachbird AG uses the gathered personal details for the proper handling of the order and payment by the user/customer and for the purpose of providing access and for the use of electronic services on the websites of Reachbird AG. Furthermore, the data is also used to make the services of Reachbird AG user-friendly (e.g. so that certain data does not have to be entered several times, such as in connection with logging in), in order to design offers and advertising messages that are tailored and adapted to the user/customer, in order to recognise open demand for products and services and to produce new ranges of services and products based upon this, in order to produce statistics on the calling behaviour of the user/customer regarding the websites of Reachbird AG and about the purchases made by the user/customer via the websites of Reachbird AG, and in order to evaluate and improve the quality and handling of the websites and the corresponding services on an ongoing basis.
§ 6 To whom are the personal details passed on?
As a basic principle, Reachbird AG does not pass on any personal details to third parties. Exceptions to this are legal obligations and companies working on behalf of Reachbird AG which are rendering a service for Reachbird AG desired by the user/customer. This applies in particular to the cases in which Reachbird AG acts only as intermediary. These companies are obliged to maintain secrecy and to abide by the data privacy statement of Reachbird AG.
If Reachbird AG is sold or a merger takes place between Reachbird AG and another company, the user/customer agrees to all data also being passed on to the legal successor of Reachbird AG. Reachbird AG is not liable for losses arising due to misuse/illegal use of the personal data by third parties. If the user/customer makes use of services for which it is necessary to enter personal data about the recipient (e.g. greeting cards, etc.), one should ensure that the person concerned consents to this passing on of data.
§ 7 Where and for how long are personal details kept?
The data of the user/customer are saved in a protected and secured operating environment in a datacentre in Amsterdam. Access is restricted, sensitive data is transferred encrypted and the employees of Reachbird AG are regularly instructed regarding data privacy. The personal data and information provided by the user/customer is protected against unauthorised access by third parties with the greatest possible care. Reachbird AG will, within reason, take all measures to ensure the safety of personal data. The user/customer is, however, advised that the world wide web is globally accessible for everyone and in particular that misuse cannot be ruled out, so that even the unauthorised accessing by third parties of data and information of this kind cannot be ruled out. Reachbird AG saves the data entered by you only for as long as we need it for the intended purpose; afterwards it is deleted and/or anonymised.
§ 8 What rights does the user/customer have? What are the consequences of refusing to provide information?
The user/customer can at any time demand information about whether data about them is being processed at Reachbird AG; furthermore, the user/customer can demand the correction of incorrect data and at any time informally (partially) revoke their declaration(s) of consent (where granted) regarding their data and have its passing on to third parties blocked. The user/customer in question is also entitled to a right of objection against the use of their data. The corresponding declarations of the user/customer are to be sent to the address of Reachbird AG. The contact details can be found in § 9 of this data privacy statement. If the required personal details are not provided, Reachbird AG will not enter into a contract with the user/customer and will not make any other services available to the user/customer either. The provision of personal details is thus a requirement for the use of services of Reachbird AG. Apart from that, the user/customer can always decide freely whether to only provide certain information to Reachbird AG (e.g. only a "minimum registration"), which can however mean that the user/customer is not able to use all the services of Reachbird AG.
